The Supreme Court’s Clear Mandate
The Supreme Court’s order provided a detailed roadmap for all States and Union Territories (UTs) to ensure effective education for children with special needs. Key directives included:
- Notification of Sanctioned Posts: States and UTs were required to issue notifications detailing the exact number of sanctioned posts for special education teachers.
- Timely Advertisement: These posts, once sanctioned and notified (by March 28, 2025), had to be widely advertised in newspapers and on official education and government websites.
- Qualified Appointments: The selection process was mandated to exclusively involve qualified, competent, and eligible teachers, with the Rehabilitation Council of India (RCI) qualification certificate being absolutely mandatory.
- Screening Committee for Ad-hoc Teachers: Recognizing the long service of many contractual teachers (some for nearly two decades), the Court directed the immediate formation of a Screening Committee. This committee includes the State Commissioner for Persons with Disabilities, the Secretary of Education, and an RCI nominee.
- Screening and Regularization: This committee is tasked with examining the cases of existing contractual/daily wage teachers. Those found competent, eligible, and RCI-qualified will be granted the pay scale of a special teacher, with their past experience considered.
- Age Relaxation: The Screening Committee is also empowered to grant age relaxation for long-serving teachers.
- Strict Timelines: All processes, including the identification of sanctioned posts, were to be completed within twelve weeks from the order date (March 7, 2025).
- Prospective Pay Scale Benefits: Benefits of the new pay scale will apply prospectively from the date of appointment after selection, not retrospectively.
Uttar Pradesh’s Proactive Response: Quantifying the Need

Dedicated Committee Formed: On April 17, 2025, the Basic Education Department established a committee comprising the Director of Education (Basic), Finance Controller, Secretary of the Basic Education Council, and a Senior Expert from Samagra Shiksha. 2. Detailed Assessment of Children with Special Needs: As of March 31, 2025, a comprehensive count revealed 87,817 children with 40% or more disability certificates enrolled in primary, upper primary, and composite schools under the Basic Education Council.
After careful review, it was determined that 22,607 of these children (including those with locomotor disability, haemophilia, thalassemia, sickle cell disease, chronic neurological conditions, Parkinson’s disease, multiple sclerosis, acid attack victim status, dwarfism, and leprosy cured conditions) do not currently require specialized teaching as per RCI guidelines and can be educated by general teachers.
Therefore, 65,210 disabled children have been specifically identified as requiring special teachers for their education and training.

Sanctioning of 5,352 Special Educator Posts
Following the Government of India’s notification (September 27, 2022) which sets a teacher-pupil ratio of 1:10 for primary schools and 1:15 for upper primary schools, a total of 5,352 special teacher positions are now required to cater to the 65,210 identified children.

This committee held its first meeting on July 4, 2025, outlining key recommendations:

- Age Relaxation: Contractual special educators will receive age relaxation, allowing adjustment against special teacher posts up to a maximum age of 60 years.
- Mandatory Qualifications: A graduate degree combined with an RCI-recognized 2-year D.Ed. (Special Education) for primary level, or a 2-year B.Ed. (Special Education) for upper primary level, or an equivalent RCI-recognized degree, is essential.
- Post-Appointment Training: Appointed D.Ed./B.Ed. (Special Education) holders must undergo a 6-month special training program in elementary education provided by the National Council for Teacher Education (NCTE).
- Active RCI Registration: An active CRR (Central Rehabilitation Register) number with an RCI registration certificate is compulsory.
- Two-Phase Screening for Contractual Educators:
- Preliminary Screening (First Two Months): Collection of academic, training, and age-related documents from contractual special educators. Those with valid TET/CTET qualifications and meeting other conditions will be considered for appointment.
- Second Phase Screening (for Non-TET/CTET Holders): For those without valid TET/CTET, the state will conduct a Special Teacher Eligibility Test (STET). Educators will have two opportunities to clear the STET, with the second attempt within one year of the first.
- STET Age Limit: Special educators can appear for the STET up to a maximum age of 60 years (as on the exam date).
- STET Guidelines: The STET will be conducted under NCTE’s revised/new guidelines.

- The conversion and notification of the 5,352 vacant assistant teacher posts into special teacher posts.
